Terms and Conditions

**If you, the Client, agree to Tuition with a Tutor introduced to you by Joy Learning then you agree to abide by the Terms and Conditions stated below. If you do not agree to these Terms and Conditions, you must stop using the Joy Learning platform and service immediately.**

**Payment**

1. Joy Learning is a tutoring agency that connects clients with self employed tutors

2. Joy Learning provides a secure platform for all online lessons to be managed

3. All lessons must be delivered through the secure Joy Learning platform only

4. The client will be requested to pay the tuition fee after the completion of each lesson

5. Clients pay the tuition fee via the Joy Learning platform only

6. Lesson Fees for completed Lessons are non-refundable.

7. The full lesson fee will be charged for a lesson in which the tutee is absent without adequate cancellation notice.

8. If a Tutee is late to a Lesson, the Tutor is not obliged to extend the lesson time to make up for the lost time, this decision will be made at the Tutor’s discretion.

**Cancellations**

1. A lesson cancellation must be requested at least 24 hours prior to the lesson time

2. Lessons may be cancelled by a Client or Tutor in cases of illness or emergency

3. Cancellations must be requested in writing to Joy Learning via Email or Message

4. If the Client cancels a lesson less than 24 hours before the start of a lesson, then the Client shall be obliged to pay the full fee of the lesson.

5. If the Tutor cancels a lesson less than 24 hours before the start of a lesson, then the Client will not be charged a cancellation fee.

6. Joy Learning reserves the right to request that a Tutor stop arranging Lessons with the Client at any time.

7. A Client or Tutee should inform Joy Learning of a Complaint within 48 hours of the scheduled finish time of the relevant lesson.

8. Joy Learning reserves the right to terminate a Client or Tutor’s access to any part of the Joy Learning Website and platform.

**Limitations**

1. The Client or Tutee shall not arrange undisclosed lessons with the Tutor without the consent and knowledge of Joy Learning.

2. A Client or Tutee agrees not to make any agreement or arrangement with a Tutor which is intended to circumvent the relationship between Joy Learning and a Tutor.

3. A Tutee or Client must not request a Tutor to complete assignments, essays or coursework.

4. On request, the Client must disclose to Joy Learning the details of each lesson given by a Tutor.

5. Joy Learning does not guarantee that a Tutor will meet the Tutee's needs.

6. Joy Learning is not responsible for any grade received by a Tutee or any consequence that examination grades entails.

**Website**

1. Joy Learning reserves the right to withdraw or modify aspects of the Joy Learning website at any time.

2. Joy Learning may vary the features of the Joy Learning website and the Terms and Conditions at anytime at their sole discretion.

3. Joy Learning may restrict access to the Joy Learning website for any period at the sole discretion of Joy Learning.

4. Joy Learning give no guarantee that the Joy Learning Website is free from errors, viruses, worms or any other form of harmful components.

5. Joy Learning is not liable for direct, indirect, consequential or any other form of loss or damage that may be suffered by a Client or Tutor through the use of the Joy Learning website including loss of data or information or any kind of financial or physical loss or damage.

**Definitions and Interpretation**

1. Joy Learning: A business owned by Joy Awelenje, trading as Joy Learning Limited.

2. Tuition: The ongoing delivery of Lessons provided by a Tutor, for which the Client promises to pay.

3. Lesson: A period of time in which a Tutor provides Tuition for a Tutee, as requested by a Client.

4. Client: The person requesting and paying for Tuition.

5. Tutor: The person delivering Lessons to a tutee, as requested by a Client.

6. Tutee: The person receiving Lessons from a tutor, as requested by a Client.

7. Lesson Fee: Amount charged for an individual Lesson delivered by a Tutor
